This Privacy Policy explains how AuctionKhoj ("AuctionKhoj", "we", "us" or "our"), which operates the website auctionkhoj.com (the "Website"), collects, uses, stores, shares and protects information about you when you visit the Website, subscribe to our auction alerts or contact us. We are committed to handling personal data responsibly and in accordance with applicable Indian law, including the Digital Personal Data Protection Act, 2023 (the "DPDP Act"), the Information Technology Act, 2000 and the rules made under it. By using the Website you acknowledge that you have read this Privacy Policy. Where we rely on your consent, we will ask for it clearly and you may withdraw it at any time.

1. Who We Are

AuctionKhoj is an information website based in India that aggregates publicly published bank auction notices, including SARFAESI sales, Debt Recovery Tribunal sales, liquidation sales under the Insolvency and Bankruptcy Code, 2016, and vehicle and gold auctions. We do not conduct auctions and we are not affiliated with any bank. For the purposes of the DPDP Act, AuctionKhoj acts as the Data Fiduciary in relation to the personal data described in this policy. 2. Information We Collect

2.1 Information you provide to us

Auction alert subscriptions: when you subscribe to free email alerts we collect your email address, your preferred city and, if you choose to provide it, a preferred asset category.
Contact and report-an-error forms: when you write to us we collect your name, email address, phone number (if provided) and the content of your message, including any listing or auction reference you include.
Emails you send us: if you email us directly, we receive your email address and whatever information you choose to include.

You do not need to create an account to browse the Website, and we do not ask for sensitive financial information such as bank account details, card numbers or passwords. Please do not send us such information.

2.2 Information collected automatically

Technical data: your Internet Protocol (IP) address, browser type and version, device type, operating system, language settings, referring website and the date and time of your visit.
Usage data: the pages you view, the searches and filters you use, the listings you open, the links you click and how long you spend on pages.
Form security data: when you submit a contact or report-an-error form we record the IP address from which it was submitted, to help us prevent spam, abuse and fraud.
Cookies and similar technologies: small files and identifiers placed on your device by us and by third parties, as explained in Section 5 and in our Cookie Policy.

2.3 Information stored only on your device

Listings you save as favourites are stored in your browser's local storage on your own device. This information is not sent to our servers, and we cannot see it. You can remove it at any time by clearing favourites on the Website or clearing your browser's site data.

2.4 Information in auction listings

Auction notices published by banks and authorities under law may contain the names of borrowers, guarantors or companies, and details of the secured asset. We reproduce such details only to the extent they appear in public statutory notices, for the purpose of informing the public about the sale. If you believe a listing contains inaccurate or outdated information about you, please contact us as described in Section 10.

3. How We Use Your Information

We use the information we collect for the following purposes:

To operate, maintain and improve the Website, including search, filters and listing pages
To send you the auction alerts you have subscribed to, based on your chosen city and category
To respond to your enquiries, correction requests and feedback, and to correct listings where needed
To understand how visitors use the Website through analytics, so that we can improve content and usability
To display advertising, which funds the free service, as described in Section 5
To detect, prevent and investigate spam, fraud, security incidents, scraping and other misuse
To comply with legal obligations and respond to lawful requests from government authorities
To enforce our Terms of Use and protect our rights and the rights of our users

We will not use your email address for purposes unrelated to the alerts or correspondence you requested, and we do not sell your personal data.

4. Legal Basis for Processing

We process personal data on the basis of your consent (for example, when you subscribe to alerts, submit a form or accept non-essential cookies) and for certain legitimate uses permitted under the DPDP Act, such as where you voluntarily provide data for a specified purpose, or where processing is necessary to comply with law or a court order. You may withdraw your consent at any time. Withdrawal will not affect processing carried out before it, but we may no longer be able to provide the related service, such as email alerts.

5. Advertising, Cookies and Third-Party Vendors

AuctionKhoj is free to use because it is supported by display advertising. We use Google AdSense and may work with other advertising networks and partners to show advertisements on the Website.

Third-party vendors, including Google, use cookies to serve ads based on a user's prior visits to this Website and other websites on the Internet.

9. Data Retention

We keep personal data only for as long as it is needed for the purpose for which it was collected, or as required by law. Subscriber email addresses and preferences are kept until you unsubscribe, after which they are deleted or anonymised within a reasonable period, except for a minimal suppression record that ensures we do not email you again. Contact form messages and associated IP addresses are generally retained for up to 24 months so that we can follow up on requests and maintain records of corrections, unless a longer period is required for legal reasons. Analytics data is retained according to the retention settings configured in Google Analytics. Server logs are kept for a limited period for security purposes.

Subject to the DPDP Act and applicable rules, you have the following rights in relation to your personal data:

Right to access information: to obtain a summary of the personal data we process about you and the processing activities we carry out, and the identities of other Data Fiduciaries and Data Processors with whom it has been shared.
Right to correction and completion: to ask us to correct inaccurate or misleading personal data, complete incomplete data or update it.
Right to erasure: to ask us to erase personal data that is no longer necessary for the purpose for which it was processed, unless retention is required by law.
Right to withdraw consent: to withdraw consent you have given, as easily as you gave it. You can unsubscribe from alerts using the link in every alert email.
Right of grievance redressal: to have your grievances regarding our handling of your personal data addressed by us.
Right to nominate: to nominate another individual to exercise your rights in the event of your death or incapacity.

12. Data Security

We implement reasonable security practices and procedures, as contemplated by the Information Technology Act, 2000, to protect personal data against unauthorised access, alteration, disclosure or destruction. These measures include encrypted HTTPS connections, access controls that limit who can view personal data, secure hosting and regular software updates. However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security. In the event of a personal data breach, we will take appropriate steps and make notifications as required by law.

13. International Transfers

Some of our service providers, including Google, may process data on servers located outside India. Where personal data is transferred outside India, we will do so only in compliance with the DPDP Act and any restrictions notified by the Government of India.

14. Children's Privacy

The Website is intended for adults interested in bank auctions and is not directed at children. We do not knowingly collect personal data from anyone under 18 years of age. If you believe a child has provided us with personal data, please contact us and we will delete it.

15. Third-Party Websites

Listings on the Website link to bank websites, e-auction portals, IBBI, tribunals and other third-party sites, and advertisements may link to advertisers' sites. We are not responsible for the privacy practices or content of those websites. When you leave our Website, please read the privacy policy of the site you visit, particularly before registering or making any payment on an e-auction portal.
