These Terms of Use ("Terms") govern your access to and use of auctionkhoj.com and all related pages, features, email alerts and services (together, the "Website") operated by AuctionKhoj ("we", "us" or "our"). By accessing or using the Website, you agree to be bound by these Terms, our Privacy Policy, our Disclaimer and our Cookie Policy. If you do not agree, please do not use the Website.

1. About the Website

AuctionKhoj is an online information service that aggregates and summarises auction notices that have been publicly published by banks, non-banking financial companies, housing finance companies, asset reconstruction companies, Debt Recovery Tribunals, insolvency professionals and liquidators, and e-auction portals in India. The Website is intended to help users discover auctions and understand the auction process.

AuctionKhoj is not a bank, lender, auctioneer, e-auction service provider, real estate agent, broker or legal adviser. We do not conduct auctions, invite or accept bids, collect earnest money deposits, hold funds, issue sale certificates, deliver possession or transfer title to any asset. We are not affiliated with, endorsed by or acting on behalf of any bank, tribunal, the Insolvency and Bankruptcy Board of India or any government authority. All auctions are conducted solely by the concerned institution or its authorised service provider, under its own terms and conditions.

2. Eligibility and Use of the Website

You may use the Website only if you are legally capable of entering into a binding contract under the Indian Contract Act, 1872. You agree to use the Website only for lawful purposes and in accordance with these Terms. Most features of the Website may be used without an account. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Website for your personal, non-commercial purpose of researching auctions.

3. Accuracy of Information – Always Verify With the Bank

Auction information on the Website is compiled from public sources and summarised by us. Although we take reasonable care, notices may contain errors at the source, may be summarised incorrectly, and may change after publication. Auctions are frequently postponed, cancelled, withdrawn, re-notified with a different reserve price, or stopped because the borrower has repaid the dues.

Accordingly, all information on the Website, including reserve prices, EMD amounts, dates, property descriptions, areas, locations, photographs, encumbrances and contact details, is provided on an "as is" and "as available" basis for general information only. You must always read the official sale notice and the complete terms and conditions of sale published by the bank or authority, and confirm every material detail directly with the authorised officer, before inspecting, paying any EMD, submitting a bid or making any other decision. The official notice and the bank's own terms prevail over anything shown on the Website in case of any inconsistency.

You are solely responsible for conducting your own due diligence, including verification of title, statutory dues, society and utility dues, encumbrances, litigation, physical possession status, building approvals and the physical condition of the asset. We strongly recommend taking independent legal, technical and financial advice before participating in any auction.

4. No Professional Advice

Guides, articles, FAQs and other content on the Website are provided for general educational purposes and do not constitute legal, financial, tax, investment or real estate advice. Nothing on the Website is a recommendation to buy or bid for any particular asset.

5. Email Alerts

You may subscribe to free email alerts by providing your email address, city and, optionally, an asset category. You agree to provide an email address that belongs to you. Alerts are sent as a convenience only; we do not guarantee that every relevant auction will be included, that alerts will be delivered on time, or that they will be error-free. You may unsubscribe at any time using the link in any alert email.

6. Favourites

The favourites feature stores your saved listings in your browser's local storage. Favourites are not backed up by us, may be lost if you clear your browser data or switch devices, and may refer to auctions that are later changed or removed.

7. Intellectual Property

The Website and its original content, including its design, layout, text, guides, graphics, logos, the name "AuctionKhoj", compilations, data structures, software and the selection, arrangement and presentation of listing information, are owned by or licensed to us and are protected by the Copyright Act, 1957, the Trade Marks Act, 1999 and other applicable laws. Underlying facts contained in public auction notices remain in the public domain, and trademarks, names and logos of banks and other third parties belong to their respective owners and are used only for identification.

Except as expressly permitted by these Terms, you may not copy, reproduce, republish, distribute, modify, create derivative works from, publicly display, sell or commercially exploit any part of the Website without our prior written permission. You may share links to individual pages and quote short extracts for non-commercial purposes with a clear attribution and link to the Website.

8. Prohibited Use

You agree that you will not, and will not attempt to or assist anyone else to:

  • Use any robot, spider, crawler, scraper, script, browser automation or other automated means to access, copy, extract, index or monitor the Website or its listings, or systematically download data to build a database, directory or competing service, except for general-purpose search engines that respect our robots.txt file
  • Bypass, disable or interfere with any security feature, rate limit, access control or technical measure on the Website
  • Frame, mirror or reproduce the Website or any substantial part of it on another website or application
  • Introduce viruses, malware or any code that is harmful or disrupts the operation of the Website

We may block access, remove content, suspend alert subscriptions or take legal action where we reasonably believe these Terms have been breached.

9. Third-Party Links and Advertisements

The Website contains links to third-party websites, including bank websites, e-auction portals, government and tribunal websites, and advertisers. The Website also displays advertisements served by Google AdSense and other advertising partners. We do not control and are not responsible for the content, accuracy, availability, privacy practices, products or services of any third-party website or advertiser. The inclusion of a link or advertisement does not imply our endorsement. Any dealings you have with third parties, including registration, payment of EMD or bid amounts on an e-auction portal, are solely between you and that third party.

10. User Submissions

If you send us feedback, correction reports, auction notices or other content, you confirm that you have the right to share it and that it is accurate to the best of your knowledge. You grant us a non-exclusive, royalty-free, perpetual licence to use, reproduce and publish such content for the purpose of operating and improving the Website. We may, at our discretion, decline to act on any submission.

11. Disclaimer of Warranties

To the maximum extent permitted by law, the Website and all content and services are provided without any warranty of any kind, express or implied, including warranties of accuracy, completeness, timeliness, merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the Website will be uninterrupted, secure or free from errors or harmful components.

12. Limitation of Liability

To the maximum extent permitted by applicable law, AuctionKhoj, its owners, employees and partners shall not be liable for any direct, indirect, incidental, special, consequential or punitive loss or damage arising out of or in connection with your use of, or inability to use, the Website or reliance on any information on it. This includes, without limitation, loss of EMD or bid amounts, loss of profit or opportunity, costs of litigation, liability for outstanding dues or encumbrances, disputes over title or possession, or losses arising from a cancelled, postponed or withdrawn auction. Where liability cannot be excluded by law, our total aggregate liability shall not exceed one thousand Indian rupees (INR 1,000).

13. Indemnity

You agree to indemnify and hold harmless AuctionKhoj and its owners, employees and partners from any claims, losses, liabilities, damages, costs and expenses, including reasonable legal fees, arising out of your breach of these Terms, your misuse of the Website or your violation of any law or third-party right.

14. Availability and Changes

We may modify, suspend or discontinue any part of the Website, remove or edit any listing, or change these Terms at any time without prior notice. The updated Terms will be posted on this page and will be effective from the time of posting. Your continued use of the Website after changes are posted constitutes acceptance of the revised Terms.

15. Governing Law and Jurisdiction

These Terms are governed by and shall be construed in accordance with the laws of India, including the Information Technology Act, 2000.
